Terms of Service
1. Acceptance of these Terms
These Terms of Service (the “Terms”) form a binding agreement between you (“you” or “User”) and TradingBear (“TradingBear,” “we,” “us,” or “our”), the operator of the TradingBear mobile application and related websites (collectively, the “Service”).
By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. The TradingBear service
TradingBear is an iOS application that provides educational tools, market information, charting, an AI assistant, a personal trading journal, and an in-app community where users can share ideas and discuss markets. The Service is informational only and does not execute trades, hold funds, or provide brokerage services.
Features may be added, removed, or modified at any time. We may impose usage limits or gate certain features behind paid subscriptions.
3. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and legally able to enter contracts in order to use the Service. The Service is not directed at children and we do not knowingly collect data from anyone under 13.
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at team@tradingbear.app if you suspect unauthorized use.
You agree to provide accurate information when registering and to keep that information current.
4. AI output disclaimer
The Service includes an AI assistant that generates text, summaries, chart commentary, and other output (“AI Output”). AI Output is generated probabilistically, may be incomplete, biased, out-of-date, or plainly wrong, and is provided for educational and exploratory purposes only.
AI Output does not constitute:
- investment, financial, accounting, tax, or legal advice;
- a recommendation to buy, sell, or hold any security, token, or derivative;
- a guarantee of any outcome, return, or signal accuracy.
Always verify information independently and consult a qualified professional before acting on anything you see in the Service.
5. Market and crypto risk
Trading financial instruments — including stocks, forex, futures, options, and digital assets such as cryptocurrencies — involves substantial risk. Prices can move rapidly and you can lose all of the capital you risk.
Digital-asset markets may be particularly volatile, operate 24/7, are subject to uneven regulation across jurisdictions, and may be affected by technical failure, liquidity shocks, or exchange insolvency. Past performance is not indicative of future results.
You are solely responsible for evaluating whether any strategy, signal, or piece of information is appropriate for your circumstances, and for complying with the laws that apply to you.
6. User-generated content & community rules
The Service lets you post messages, images, strategies, comments, trade reviews, and other content (“User Content”) into community channels, direct messages, and journals. You retain ownership of your User Content, but you grant TradingBear a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit your User Content solely to operate and improve the Service.
You agree not to post, upload, share, or transmit any User Content that:
- is hateful, harassing, threatening, bullying, or discriminatory;
- sexualizes, endangers, or exploits minors in any way;
- is pornographic, obscene, or gratuitously violent;
- defames, invades the privacy of, or impersonates another person;
- promotes illegal activity, self-harm, or the use of weapons;
- constitutes a pump-and-dump scheme, market manipulation, insider trading, or any other unlawful market activity;
- constitutes personalized financial advice without proper licensure;
- infringes any copyright, trademark, trade secret, or other intellectual-property right;
- contains malware, spam, phishing links, or credential-harvesting;
- contains personal data of others posted without their consent;
- violates any applicable law or regulation.
You are solely responsible for your User Content. We do not pre-screen User Content, but we may remove it, restrict its distribution, or suspend or terminate the posting account at our discretion.
7. Reporting, blocking & moderation
Every user has in-app tools to report objectionable content and to block abusive users. You can:
- press and hold any community message to Report it for review;
- press and hold any community message to Block its sender, which immediately hides all of that user’s messages from your view;
- email team@tradingbear.app with a description and, where possible, a screenshot.
We aim to review reports and act on violations within 24 hours. Actions we may take include removing content, warning the offending user, suspending the account, or — for severe or repeated violations — permanently terminating access and, where appropriate, referring the matter to law enforcement.
8. Subscriptions, purchases & refunds
Certain features may require an in-app purchase or a recurring subscription billed through your Apple ID. Prices, billing intervals, and free-trial terms are disclosed at the point of purchase inside the app.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
- Manage or cancel subscriptions in Settings → Apple ID → Subscriptions on your device.
- All payments are processed by Apple; refund requests must be made through reportaproblem.apple.com in accordance with Apple’s policies.
9. License and acceptable use
Subject to these Terms, TradingBear grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Service for your personal, non-commercial use.
You agree not to:
- copy, modify, reverse-engineer, decompile, or create derivative works of the Service;
- scrape, crawl, or systematically extract data from the Service;
- use the Service to build a competing product or model;
- bypass rate limits, access controls, or security measures;
- use automated systems (bots, scripts) to post, vote, or interact in the community;
- resell, rent, or sublicense access to the Service.
10. Third-party services
The Service integrates with third-party providers to deliver its functionality, including but not limited to:
- Apple Inc. — Sign in with Apple, App Store, push notifications;
- Google LLC — Google Sign-In;
- Google / Firebase — authentication and backend services;
- Sendbird, Inc. — in-app chat and community messaging;
- TradingView, Inc. — embedded charts;
- Cloudflare, Inc. — media streaming and content delivery.
Your use of these third-party components is subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.
11. Intellectual property
The Service, including its software, design, text, graphics, logos, and the “TradingBear” name, is owned by TradingBear or its licensors and is protected by copyright, trademark, and other laws. Except for the limited license in Section 9, no rights are granted to you.
If you believe content on the Service infringes your copyright, please email us at team@tradingbear.app with a DMCA-style notice identifying the work and the infringing material.
12. Termination and account deletion
You may delete your account at any time from Settings → Delete account inside the app, or by emailing team@tradingbear.app. Deletion is permanent and removes your profile, journal entries, and personal messaging data in accordance with our Privacy Policy. Some records may be retained where required by law or for legitimate business reasons (for example, fraud prevention or audit trails).
We may suspend or terminate your access immediately, without notice and without refund, if we reasonably believe you have violated these Terms, created legal or safety risk for other users, or misused the Service.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.
WE DO NOT WARRANT THAT MARKET DATA, SIGNALS, OR AI OUTPUT WILL BE ACCURATE, COMPLETE, OR TIMELY. YOU ASSUME ALL RISK OF RELIANCE ON THE SERVICE.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADINGBEAR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50.
15. Indemnification
You agree to defend, indemnify, and hold harmless TradingBear and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any applicable law.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will post the revised Terms here and update the “Last updated” date. For significant changes we will provide at least 30 days’ advance notice in-app or by email. Your continued use of the Service after the effective date constitutes acceptance.
17. Governing law & disputes
These Terms are governed by the laws of the Republic of China (Taiwan), without regard to conflict-of-law principles. The parties submit to the exclusive jurisdiction of the Taiwan Taipei District Court as the court of first instance, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual-property rights.
If you are a consumer resident in the European Union, United Kingdom, or another jurisdiction whose law grants you rights that cannot be waived by contract, nothing in this section limits those rights.
